The booking terms and conditions set out below and the general information on our website and in our brochures and all correspondence apply to all bookings with Educating Adventures Limited (also referred to as ‘EA Mountain Bike Training’ ‘We’ or ‘Us’). Changes to the booking terms and conditions will only be valid if Educating Adventures Limited confirms in writing.
1. Contract
A binding contract is only entered into when we have received your payment of the program deposit.
2. Prices & Payments
We will do our best to ensure that prices listed on our website, in our phone conversations and in our correspondence (such as emails, newsletters, handbooks, and guides) are accurate. Prices are subject to change until full payment is received. The deposit payment is required at the time of booking. Bookings made more than 6 months prior to program commencement require a $2000 installment payment three months after the deposit payment (unless final payment as below is due earlier). Subsequent payments are due as follows:
Northern Hemisphere Programs:
• For bookings made before 31 December, the final payment is due on 31 January unless prior agreement is made.
• For bookings made between 1 January and 31 March, the final payment is due within 30 days unless prior agreement is made.
• Final payments for bookings made after 31 March are due by 30 April or the time of booking (whichever is later) unless prior agreement is made.
Southern Hemisphere Programs:
• For bookings made before 31 May the final payment is due on 30 June unless prior agreement is made.
• For bookings made between 1 June and 31 August, the final payment is due within 30 days unless prior agreement is made.
• Final payments for bookings made after 31 August are due by 30 September or the time of booking (whichever is later) unless prior agreement is made.
Payments for elements that do not form part of your package with Educating Adventures Limited (such as flights, travel insurance, visas, accommodation and other living costs) will be made directly to the respective agent or supplier and you will be bound by the agents or suppliers booking terms and conditions. Where we have provided information including guides on expected costs these are provided in good faith and may vary to actual.
3. Cancelation by you
3.1 You may cancel your program at any time provided you confirm the cancellation in writing (either by letter or e-mail).
3.2 Cancellations will receive no refund. Any outstanding payments for cancellations made after the final payment due date will still be payable (also refer clause 9.3).
4. Cancelation by us
4.1 We start planning the programs we offer months in advance. Whilst we always endeavor to avoid making changes and cancellations we reserve the right to do so.
4.2 Cancellations by us
On rare occasions, we may need to cancel your program (or a program component) in which case we will notify you as soon as reasonably possible. If the cancellation is due to a circumstance beyond our control (see below 4.3) we will not provide a refund of payments (or refund of the program component) made to us. If you do not make payments on time we reserve the right to cancel your program and collect any payments outstanding including any associated collection costs (also refer clause 9.3).
4.3 Circumstances beyond our control
Occasionally we may have to change or cancel your program as a result of factors outside our control or where we or any excursion provider or operator could not foresee or avoid after taking all reasonable care. Examples are war or threat of war, riots, civil strife, terrorist activity, fire or adverse weather conditions. We cannot pay any compensation, expenses, losses or any amount or otherwise accept responsibility as a result of circumstances beyond our control.
5. Exchange rates
Prices are payable in the currency as listed on the dates and prices page of our website. We may provide you with prices in the currency of your country of residence for information purposes. These amounts should be used as a guide only as they are subject to change based on applicable exchange rates at the time of payment.
6. Travel insurance
Adequate Travel insurance for the duration of your program should be bought. You should discuss your requirements with your agent and ensure the policy you buy is adequate. We cannot be responsible for your costs of failing to take out adequate travel insurance. You may be required to pay for medical and other insurance related costs upfront. It is your responsibility to have adequate monies such as cash, cheques or credit card facilities to cover these costs.
7. Liability
7.1 General
As Educating Adventures Limited and its employees, representatives and agents act only as a booking agent no liability whatsoever is accepted for any aspect of the arrangements and, in particular, no liability is accepted for any accidents, loss, injury, sickness, death or damage you may suffer prior to, during or after any program or excursion.
7.2 Mountain biking carries inherent risk
Without limiting clause 7.1 and in specific regard to mountain biking, you acknowledge that using a mountain bike park or specific mountain bike trails, including its lifts and participation in resort activities for any purpose can be hazardous and you assume all risks. You agree to hold harmless, release, defend and indemnify Educating Adventures Limited, their employees, representatives and agents from all liabilities and/or claims for injury or death to persons or damage to property.
7.3 Program Resort and Employment
While we do our best to accommodate your resort preference we cannot guarantee this. If we are unable to place you at your preferred resort or you do not receive a conditional Offer of Employment at your preferred resort we will organise an alternative resort option. Where we provide you with assistance in obtaining employment our role is to introduce you to a prospective employer so you can obtain a conditional Offer of Employment. The conditions outlined in this Offer of Employment vary from resort to resort and may include but are not limited to, resort business levels, passing the level 1 exam and presenting a valid work visa (refer clause 7.4). If the conditions of your Offer of Employment are not met and you are not eligible for employment you will not be entitled to any refund and this may also affect your accommodation, employee season pass and other program components and may involve an additional cost. Your employment agreement, any employment issues, and any other arrangements associated with your employment are considered to be outside arrangements and do not form part of your program with us (refer clause 7.5). Where we have provided information including guides on expected hours, income or other terms of employment, these are provided in good faith and may vary to actual. You agree to hold harmless, release, defend and indemnify Educating Adventures Limited, their employees, representatives and agents from all liabilities and/or claims in relation to employment.
7.4 Visas
If you require a visa to participate we cannot guarantee you will receive a visa as this is subject to factors outside our control such as laws, regulations, immigration and customs procedures of the relevant country. Obtaining a visa is considered to be an outside arrangement and does not form part of your program (refer clause 7.5). If you are taking part in our Instructor Internship Program and you do not obtain a visa some program components with Educating Adventures Limited which require this work visa may not be made available and involve an additional cost. You agree to hold harmless, release, defend and indemnify Educating Adventures Limited, their employees, representatives and agents from all liabilities and/or claims in relation to work visas. If you are unable to get a visa and therefore are unable to undertake employment you will not be entitled to any refund.
7.5 Outside Arrangements
Educating Adventures Limited is not responsible for any outside arrangements you may make before, during or after participating in a program. This includes, but is not limited to any element booked or arranged in conjunction with your program with Educating Adventures Limited (such as flights, travel insurance, post training accommodation, post course training and/or exam, visas, and employment) even in the case where but not limited to Educating Adventures Limited making a recommendation, introduction, or referral.
7.6 Optional Activities
Optional and other activities may not be available at all times as these are managed by independent local operators. We have no control over their availability or prices.
7.7 Travel Insurance
We accept no liability for the costs associated of you failing to take out adequate travel insurance.
7.8 Financial Liability
Without limiting clauses 7.1 to 7.8 Educating Adventures Limited liability in respect of all other losses shall be limited to the invoiced value of the program.
7.9 Legal Jurisdiction
Your contract with Educating Adventures Limited is subject to New Zealand law and the exclusive jurisdiction of New Zealand Courts.
8. Conditions of excursion providers and operators
Excursion providers and operators provide services in accordance with their own terms and conditions and you will be bound by these terms and conditions. Some of these terms and conditions may limit or exclude their liability to you. Copies of the relevant parts of these terms and conditions are available. You and or legal guardians of participants under the age of 18 may be required to read and accept the booking terms and conditions prior to or during your program.
9. Your responsibilities
9.1 Employment and Visas
Where Educating Adventures Limited has provided you with assistance in organising outside arrangements (refer clause 7.5 above) you are responsible for applying, organising and securing those outside arrangements.
9.2 Documentation
You must ensure that you have all the necessary documentation to complete your journey including (but not limited to) drivers license, health certificate, visas and valid machine readable passport in good condition with adequate time to expiry. You should check requirements with relevant embassies if unsure. We recommend that you carry a photocopy of important documentation (such as passport, travel insurance and visa) in case the original is lost or stolen during the program. If you are unable to travel due to incomplete or incorrect travel documents there is very little we can do to help and you will also be responsible for all associated costs.
9.3 Collection Costs
Where payments are not received by the due date you will be responsible for any reasonable costs incurred by us in relation to collection including but not limited to legal fees and interest payments.
9.4 Health
You must be of reasonable physical ability and good health to participate in our programs. You must notify us of any special medical conditions that you have. You may experience altitudes sickness or face extreme temperatures and levels of humidity. If you have any respiratory or heart conditions then a confirmation of fitness to participate in the program must be obtained from your medical practitioner.
9.5 Security and Safety
You must seek your own advice regarding safety and security. Before you travel you should obtain overseas travel advice, tips and up-to-date country information from relevant consulates and embassies.
9.6 Credit Card Deposits and Extra Charges
You may be required to provide a credit card imprint against loss/damages to rooms and other equipment used during your program such as snow sports rental equipment. You should carry out an inspection of your accommodation on arrival and equipment prior to use to ensure that there are no existing damages or faults. This is important as any damages/faults not identified at this stage will most likely be attributed to you when the room or equipment is inspected at the end of your stay and you would then be liable for any reparation costs. You may incur extra charges for hotel services used that are not included in the ‘room charge’ such as telephones, safes, movie rentals and sporting facilities.
9.7 Conduct and Behaviour
Educating Adventures Limited will be responsible for overseeing the program however will not undertake supervision of program participants. You agree to accept the authority and decisions of our program representatives, excursion providers and other operators while on program. If in their opinion your health or conduct is, or is likely to be, detrimental to the safety, welfare or enjoyment of other participants or the general public then you may be excluded from all or part of the program without recourse to refund.
9.8 Special Requests
If you have special needs or requests such as dietary restrictions you must let us know at the time of booking. In the case where meals form a structured part of your program we will make every effort to ensure your requests are met and will pass this information on to our suppliers but no guarantee is given.
10. Referrals
To receive a referral payment the referring person must advise us (in writing) of the referred person name prior to the referred person paying their deposit. The referral payment will be made to the referring person once the referred person has paid for their program in full. From time to time we may increase the referral payment amount for a set period of time however payment of the increased amount will only apply to referrals made during this set period of time.
11. Complaints
In the unlikely event that a problem occurs during your Program, it is important that you immediately inform your Educating Adventures Limited representative or the provider of the service. If your complaint cannot be resolved satisfactorily at that time, you must write to our office within 28 days of your return to your home country supplying all the relevant details.
12. Acceptance and declaration
I (or my parent or legal guardian if I am under 18 years of age) have read and accept the above booking terms. I agree to act ethically and responsibly at all times while I am a participant on this program. I declare that the information and statements made on the booking form are true and that any false declaration on my part may result in forfeiture of my place on the program with no entitlement to any refund of my fee or any consequent expenditure. Additionally, I agree to repay, either directly or via Educating Adventures Limited, any and all outstanding financial obligations such as loans, telephone bills, etc, incurred during my time as a program participant.
